OUR COMMITMENT TO PRIVACY
AgileForm Inc. (“AgileForm”, “we”, or “us”) is committed to respecting and protecting your privacy. We have developed this privacy policy (“Privacy Policy”) to help you understand how we collect and use information, including any information that could be used to identify you personally (“Personal Information”). This Privacy Policy explains how we gather and use your information, whether due to your use of the Site (as hereinafter defined) or our provision of services to you.
The software provided to you, whether directly or indirectly through third-party platforms (including but not limited to Autodesk® Revit, Autodesk® AutoCAD, or Trimble Sketchup), the web page located at agileform.ca, any mobile application that we make available to you, any software we make available to you which references this Privacy Policy, and all linked pages together form the “Site”. When used herein, the term “Services” shall refer to any product or services we make available to or perform for you through the Site or otherwise (if such services are indicated as being subject to this Privacy Policy).
Please read this Privacy Policy carefully and review it periodically for the latest information about our privacy practices. By using the Site and / or making use of Services, you agree to the terms of this Privacy Policy and consent to the use of your information by AgileForm as set forth herein. If you do not agree with the practices described in this Privacy Policy, please do not provide us with your personal information or interact with the Site and / or continue using or taking advantage of the Services.
We will routinely update this Privacy Policy to clarify our practices and to reflect new or different privacy practices, such as when we add new services, functionality or features to the Site and / or Services. If we make any material changes, we will notify you by e-mail (sent to the e-mail address specified in your account) or by means of notice on the Site or Services, or directly delivered to you prior to the change becoming effective. You can determine when this Privacy Policy was last revised by referring to the date it was “Last Updated” above. If you do not agree to the revised Privacy Policy, please stop using the Site and / or Services.
THE INFORMATION WE COLLECT
We collect only personal information that is relevant and necessary to the purpose of the Site and / or Services. This information allows us to provide you with a customized and efficient experience. We collect the following types of information from our users:
A. Personal Information
Direct Communication: We receive and store any information you directly provide through the Site and / or Services or provide to us in any other way, including by e-mail. When you send an e-mail to AgileForm, we may retain your e-mail address and the contents of the e-mail you send.
Account Registration: You may have to complete a registration form and create a user account in order to access certain parts of the Services or in order to access certain user functions (including but not limited to administrator functions). As part of this registration process, we may require certain Personal Information such as your first and last name, company name, and a valid email address. Certain information may be displayed to other users of the Site when you connect with them through the Site.
Payment Information: We do not collect or store any financial information. We contract with third-party payment providers to perform all payment processing on our behalf. Any financial information you provide through the Site and / or Services is being provided directly to such third-party service providers, as identified through the Site and / or Services, and the use of such information is governed by such third-party payment provider’s then-current procedures and policies.
Non-Provision of Information: Please note that you can choose not to provide us with certain Personal Information, but then you may not be able to take advantage of all of the Services.
B. Non-Personal Information
We also may automatically collect usage information, such as the numbers and frequency of users of the Site and / or Services, pages visited and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that is intended to identify you personally. Aggregate information generally is collected through the use of cookies and web beacons as discussed below. This aggregate information helps us determine general usage patterns and modify the Services and / or Site in order to improve your experience. This type of aggregate information may be shared as set forth in this Privacy Policy.
C. Passive Gathering of Information Electronically
AgileForm receives and store certain types of information whenever you interact with the Site, including cookies and web beacons. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you register with us, a cookie helps AgileForm to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same AgileForm website, the information you previously provided can be retrieved, so you can easily use the features that you customized.
A web beacon is a small graphic image that allows the party that set the web beacon to monitor and collect certain information about the viewer of the web page, web-based document, or e-mail message, such as the type of browser requesting the web beacon, the IP address of the computer that the web beacon is sent to and the time the web beacon was viewed. Web beacons can be very small and invisible to the user, but, in general, any electronic image viewed as part of a web page or e-mail, including HTML based content, can act as a web beacon. We may use web beacons to count visitors to the web pages on the web site or to monitor how our users navigate the web site, and we may include web beacons in e-mail messages in order to count how many messages sent were actually opened, acted upon, or forwarded.
In addition to the above, AgileForm uses web beacons and cookies to help diagnose problems with its servers, analyze trends and administer the Site and the Services. Third party vendors also may use cookies on our web site. For instance, we may contract with third parties who will use cookies on our web site to track and analyze anonymous usage and volume statistical information from our visitors and members. Such information is shared externally only on an anonymous, aggregated basis. These third parties use persistent cookies to help us to improve the visitor experience, to manage our site content, and to track visitor behaviour.
From time to time we may allow third parties to post advertisements on our web site, and those third-party advertisements may include a cookie or web beacon served by the third party. This Privacy Policy does not cover the use of information collected from you by third party ad servers. We do not control cookies in such third-party ads, and you should check the privacy policies of those advertisers and / or ad services to learn about their use of cookies and other technology before linking to an ad. We will not share your personal information with these companies, but these companies may use information about your visits to this and other web sites in order to provide advertisements on the Site and other sites about goods and services that may be of interest to you, and they may share your personal information that you provide to them with others.
You can accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the AgileForm websites you visit.
HOW WE USE INFORMATION
We may use the information collected as described in this Privacy Policy for a number of purposes, including:
- to verify your log-in credentials, license particulars, and / or usage details;
- to facilitate communication between AgileForm and you including, without limitation, responding to your questions or comments, sending e-mails concerning our products and services, or to contact you for feedback regarding us, our advertisers, or our business partners, which may include the provision of your information to a third party for the purposes of managing our email communications;
- to administer your account, provide products or services to you and for AgileForm marketing and promotional activities;
- to provide you with important functionality changes to the Site and / or Services, new services, and special offers from AgileForm and reputable third parties that we think you will find valuable;
- to customize, analyze, adjust and improve the Site and / or Services to meet our or our business partners’ needs and expectations;
- to process purchase transactions you make through the Site and / or Services;
- to enforce our agreements with you, prevent fraud and other prohibited or illegal activities, for other legally permissible purposes and generally to ensure that we comply with applicable laws;
- to contact you with non-essential business communications by e-mail, if you have opted to be contacted by AgileForm by e-mail; and / or
- to share with third parties engaged by AgileForm in connection with the purposes listed above.
DISCLOSURE OF INFORMATION TO THIRD PARTIES
Rest assured that we neither rent nor sell your Personal Information to anyone and that we will share your Personal Information only as described below.
A. Fulfilment of Services
We may retain other companies and individuals to perform certain functions on our behalf. Examples include, but are not limited to, companies and individuals who: (i) administer the AgileForm accounts; (ii) process payments; (iii) conduct surveys or promotional activities; (iv) deliver products or services; or (v) provide customer support, web hosting, internet service, and data analysis. Such third parties may be provided with access to information needed to perform their functions but may not use such information for any other purpose.
B. Protection of AgileForm and Others
We may release Personal Information when we believe in good faith that release is necessary to comply with a law; to enforce or apply our terms of use and other policies; or to protect the rights, property, or safety of AgileForm, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
C. Business Transfers
In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that are transferred. Moreover, if AgileForm, or substantially all of its assets, were acquired, user information would be one of the assets transferred.
D. AgileForm Personnel
AgileForm personnel and authorized consultants and / or contractors may have access to Personal Information, where such access is necessary in the normal course of AgileForm business.
IMPORTANT DISCLOSURES, PRACTICES AND CONTACT INFORMATION
A. Sharing of Information Within Client Organization
The Services are used by a person or organization to whom they are licensed (the “Client User”) and those of its staff to whom a Client User provides access (a “Tenant User”). When a Tenant User inputs certain information to the Site or Services or uploads certain digital assets to the Site and / or Services, that information, or information contained within such digital assets, will be made available to the relevant Client User and its other Tenant Users (the “Organization Shared Information”). The Organization Shared Information includes, but is not limited to, any content owned by the Client User and uploaded to the Site or Services by a Tenant User, information and specifications contained within technical and commercial information which a Tenant User shares on the Site or Services whether owned by the Client User or not, and information or content uploaded to the Site or Services by a Tenant User for the purposes of sharing such information or content with the Client User and its personnel. Organization Shared Information does not include the Tenant User’s Personal Information.
B. Amendment and Deletion of Information by User
By visiting your account settings, you can correct, amend, add, or delete certain Personal Information on our Site and / or Services associated with your user account. You can also amend, add, or delete personal information by contacting us at support@agileform.ca. Users may also remove information or data which they have uploaded to the Site and / or Services by using the “delete” functionality included in the Services.
C. Deletion of Information by AgileForm
AgileForm reserves the right to remove any information from the Site and / or Services, including Organization Shared Information.
D. Third Party Links
We are not responsible for the practices employed by web sites linked to or from our Site or Services, nor for the information or content contained therein. Please remember that when you use a link or go from our Site or Services to another web site, including those sites that have a link on our Site or Services, you are subject to that other web site’s own rules and policies. Please read over those rules and policies before proceeding. We are not responsible for such third-party site’s collection and / or usage of your data.
E. Data Security
We maintain a variety of commercially reasonable safeguards designed to protect your Personal Information from unauthorized access and disclosure. For example, we use industry accepted tools and techniques to protect against unauthorized access to our systems.
You should be aware, however, that AgileForm has no control over the security of other web sites on the Internet that you might visit, even where such other site is linked to our Site or Services. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your information.
We want you to feel confident using the Site and Services. However, no system can be completely secure. Therefore, although we take commercially reasonable steps to secure your information, we do not promise, and you should not expect, that your information will always remain secure. In the event of a breach of the confidentiality or security of your information, we will notify you if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) we have on record for you. You should also take care with how you handle and disclose your information.
F. Children
AgileForm does not intentionally collect information about children under the age of 13. If we learn that AgileForm has collected information from a child under the age of 13, we will delete that information as quickly as possible. If you think we have collected personal information from a child under the age of 13, please contact us at support@agileform.ca.
G. Site Hosting
The Site may be hosted in the United States, Canada, or other countries from time to time. Please be aware that your information may be transferred to, stored, and processed in various countries where our servers are located. The data protection and other laws of these countries might not be as comprehensive as those in your country. By using the Site or the Services, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share that information as described in this Privacy Policy.

Unless otherwise directed by you as and when permitted by Provider, Provider reserves the right to select the jurisdiction in which Stored Information will be stored. No Rights of Third Parties
This Privacy Policy does not create rights enforceable by third parties.
